Welcome to CallMeBob! These Terms and Conditions ("Terms") govern your access to and use of the CallMeBob platform, operated by CallMeBob Inc. ("CallMeBob", "we", "us", or "our"). By accessing or using the CallMeBob services (the "Services"), you agree to comply with and be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you should not access or use CallMeBob.
1. Introduction
CallMeBob is an online platform that connects Customers with Independent Contractors (referred to as Providers, Handymen, or Jobers) for various services such as babysitting, cleaning, home repairs, snow removal, and more. CallMeBob operates in Montreal, Toronto, and Vancouver, Canada. By using CallMeBob, you agree to abide by these Terms, which form a legally binding agreement between you and CallMeBob.
2. Eligibility
To use CallMeBob, you must:
- Be at least 18 years old and capable of forming a binding contract.
- Agree to comply with these Terms and all applicable laws and regulations.
- By using CallMeBob, you represent and warrant that you meet these eligibility criteria.
3. User AccountsAccount Creation:
- To access the Services, users (both Customers and Providers) must create an account by providing accurate and complete information.
- You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account.
Account Maintenance:
- You agree to keep your account information accurate and up-to-date.
- You must notify CallMeBob immediately if you suspect any unauthorized access to your account.
4. Services Provided
CallMeBob serves as a platform connecting Customers ("Users seeking services") with Independent Contractors ("Providers" or "Jobers") for various services. Services offered include, but are not limited to: babysitting, cleaning, snow removal, home repairs, and other on-demand services.
Providers include individuals and agencies with a list of independent contractors offering services. CallMeBob is not involved in the actual delivery of services but acts as an intermediary for connecting users with providers.
5. Independent Contractors
- Providers are independent contractors, not employees of CallMeBob. As such, CallMeBob does not control the manner or methods in which Providers perform the services.
- CallMeBob’s liability is limited solely to facilitating the connection between Customers and Providers. We are not responsible for any damages, injuries, losses, or disputes arising from the provision of services by Providers.
- Providers are responsible for the quality of the services they provide, and CallMeBob does not guarantee or warranty the services.
6. User ConductAcceptable Use:
- You agree to use CallMeBob solely for lawful purposes. You shall not engage in any activities that could harm CallMeBob, its users, or any third parties, or interfere with the platform's functionality.
Prohibited Activities:
You shall not:
- Use CallMeBob for illegal activities or misrepresentation.
- Engage in harassment, defamation, or abusive conduct towards other users.
- Attempt to bypass or interfere with the platform’s security measures or access controls.
7. Fees and PaymentsService Fees:
- CallMeBob charges a service fee for facilitating the connection between Customers and Providers. This fee is deducted from the payment made by the Customer to the Provider.
- Payment Processing: Payments for services are processed through the CallMeBob platform. All payments are handled via secure payment gateways.
Taxes:
- CallMeBob may collect applicable taxes, including VAT or sales tax, on behalf of Providers and remit these taxes to the appropriate authorities in accordance with applicable law.
8. Identity VerificationFor Providers:
- Providers must undergo an identity verification process, which may include submitting a valid identification card (e.g., passport, driver’s license, work permit) and a photo.
- CallMeBob reserves the right to verify Providers’ identity and background to ensure compliance with legal requirements. If necessary, CallMeBob may share information with law enforcement or regulatory agencies.
9. Dispute ResolutionDisputes Between Users:
- CallMeBob encourages users to resolve disputes amicably. If a dispute cannot be resolved directly between the parties, CallMeBob may, at its discretion, assist in facilitating the resolution process but is under no obligation to do so.
Arbitration:
- Any disputes, claims, or controversies arising out of or relating to these Terms, the use of CallMeBob services, or the relationship between users shall be resolved by binding arbitration under the laws of the Province of Quebec, Canada.
10. Limitation of Liability
- CallMeBob provides the platform "as is" and makes no representations or warranties regarding the quality, safety, or suitability of the services provided by independent contractors.
- CallMeBob’s liability is limited to the maximum extent permitted by law, and we are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the platform or services.
11. Termination of Service
CallMeBob reserves the right to:
- Suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violations of these Terms or misuse of the platform.
- Upon termination, your access to CallMeBob will be revoked, and you will no longer be able to use the services or interact with the platform.
12. Intellectual Property
- All content available on CallMeBob, including but not limited to text, graphics, logos, icons, images, and software, is the property of CallMeBob or its licensors and is protected by copyright, trademark, and other intellectual property laws.
- You may not reproduce, modify, distribute, or create derivative works from any content on CallMeBob without prior written consent from CallMeBob.
13. Changes to the Terms
CallMeBob reserves the right to modify, update, or change these Terms at any time.
- Notification: Changes will be posted on the CallMeBob website or within the app, and the updated Terms will be effective immediately upon posting.
- It is your responsibility to review these Terms periodically. Continued use of CallMeBob after any changes indicates your acceptance of the updated Terms.
14. Cancellation & Refund Policy
- Customer Cancellations: If you cancel more than 2 hours before a booking’s scheduled start time, you will be charged a 25 % cancellation fee based on the total service amount.
- Provider No‑Show: If a Provider fails to arrive for a confirmed booking, we’ll issue you a full refund for that service.
15. Ratings, Reviews & Removals
- User Ratings: After each job, Customers must rate their Provider based on the quality of service received.
- Review Moderation: CallMeBob reserves the right to remove any rating or review of 2 stars or below for either a Provider or a Customer, in order to maintain a fair and constructive feedback environment.
16. Insurance & Liability Coverage
- Current Coverage: At present, CallMeBob does not provide insurance for on‑the‑job incidents or property damage.
- Future Offering: We plan to offer optional insurance packages at an additional cost—stay tuned for updates on coverage details and pricing.
17. Indemnification
You agree to defend, indemnify and hold harmless CallMeBob, its officers, directors, employees and agents, and each other User, from and against all claims, liabilities, losses, damages, costs or expenses (including reasonable legal fees) arising out of or related to:
- Your negligence or willful misconduct in using the Services;
- Any dispute you have with another User;
- Your violation of these Terms or any applicable law.
18. Force Majeure
CallMeBob shall not be liable for any delay or failure to perform its obligations under these Terms due to events beyond its reasonable control, including but not limited to natural disasters, strikes, lock‑outs, epidemics, acts of government or other force majeure events.
19. User‑Generated Content License
By uploading photos, instructions, reviews, or any other content (“Your Content”) to the platform, you grant CallMeBob a worldwide, royalty‑free, perpetual, irrevocable, transferrable, sublicensable license to use, reproduce, modify, publish, and delete Your Content for the purpose of operating, promoting, and improving the Services.
20. Communications & Location Sharing
- Location Consent: To match you with nearby Providers, you consent to real‑time location sharing via the app. You can disable location tracking at any time, but this may limit certain features.
- Notifications & Marketing: By creating an account, you opt in to in‑app messages and transactional SMS. You may opt out of marketing emails or SMS at any time by following the unsubscribe instructions provided in each message.
21. Modification of Services and Terms
CallMeBob reserves the right, at its sole discretion, to:
- Change Fees or Service Offerings (with advance notice via the app or email);
- Pause, Modify, or Discontinue any feature or service (“sunset” features);
- Update These Terms at any time—posted with a new “Effective Date” and notified to all active users. Continued use of the platform after changes means you accept the updated Terms.
